Bill Summary: HB24-1152 imposes top-down residential zoning standards in our cities by requiring cities to allow Accessory Dwelling Units (ADUs) in all single-family neighborhoods, regardless of local zoning or HOA covenants. This bill effectively eliminates single-family zoning for all neighborhoods, and converts them all to “duplex” zoning. Privacy and property values of neighbors also should be taken into account. This is not all about the ADU owner’s rights.

The owner of the primary residence should be required to live onsite, and the ADU should be a basement or single-story attached ADU only, in consideration of neighbors' privacy and to reduce excessive shading/shadowing of neighbors’ yards.

ADU’s (aka, “Granny Flats”) should not be permitted for use as short term rentals like AirBnB or VRBO which have been shown to decrease existing affordable housing availability for local workers and negatively impact neighborhood livability.
